PARENT REGISTRATION, CONSENT, AND WAIVER, RELEASE OF LIABILITY, AND ASSUMPTION OF RISK AGREEMENT
IMPORTANT: This form affects legal rights. Please read it carefully before signing.
1. Agreement to Participate. I am the parent or legal guardian of the child identified in this registration (“Child”), and I represent that I have legal authority to sign this agreement for Child. I give permission for Child to participate in F.I. For Kids Co.’s (“F.I. For Kids”) live, instructor-led food and nutrition education classes and related activities for children (collectively, the “Program”). For this Program, no real food will be prepared, handled, served, or consumed unless F.I. For Kids gives prior written notice and obtains any additional consent it requires.
2. Educational Content; No Medical Advice. I understand that the Program provides general food and nutrition education for children. Program content is not individualized medical, dietary, nutritional, or health-care advice and is not intended to diagnose, treat, cure, or prevent any condition. F.I. For Kids does not provide individualized medical nutrition therapy or medical treatment through the Program. Parents and guardians should consult an appropriate qualified health-care professional regarding a Child’s individual medical, allergy, dietary, or nutritional needs.
3. Assumption of Risks. I understand that participation in the Program involves inherent and other risks, known and unknown, including without limitation: slips, falls, strains, contact with other participants; transportation or movement within the event space; and injuries or property damage caused by the acts or omissions of Child, other participants, parents/guardians, F.I. For Kids personnel, venue personnel, or third parties.
I understand that F.I. For Kids may conduct the Program at locations it does not own or control, including public, community, donated, leased, or licensed spaces. Such locations may be owned, operated, managed, maintained, or controlled in whole or in part by third parties. I understand that the Child’s participation may involve entry onto and use of the event location, including any areas reasonably used in connection with the Program, such as common areas, parking areas, walkways, restrooms, kitchens, and classrooms.
I voluntarily assume the risks associated with my and the Child’s participation in the Program and presence at the event location, except to the extent prohibited by applicable law. I will comply, and will ensure that the Child complies, with the Program’s safety instructions and any venue rules that are provided to me before or during the Program.
4. Communications. By providing my email address and mobile telephone number during registration, I agree that F.I. For Kids may send me communications by email and text regarding my registration, class reminders, schedule changes, pickup, and safety or emergency matters. I acknowledge that my registration and use of the Program are also subject to F.I. For Kids’ Terms of Use and Privacy Policy.
5. Drop-Off, Supervision, and Pick-Up. The Program may be a drop-off program. Children age four (4) and under are not eligible for drop-off participation and must remain accompanied by a parent or legal guardian throughout the Program. For all other drop-off participants, F.I. For Kids’ supervision begins when Child checks in and is accepted by F.I. For Kids personnel at the designated Program check-in location.
F.I. For Kids’ supervision ends at the scheduled end time when Child is released from the designated Program release area to a parent, legal guardian, or authorized pickup adult listed in the registration, or, if I pre-authorize independent departure through the online registration, when Child age eight (8) or older independently leaves the designated Program release area at the scheduled end time. F.I. For Kids does not provide transportation, supervision before check-in or after release, or one-on-one supervision.
Unless I have pre-authorized Child’s independent departure, I will ensure prompt check-in and pickup. I will provide advance written notice of any change to an authorized pickup adult or restriction on Child’s release. F.I. For Kids may request reasonable identification if it cannot confirm a pickup person’s identity or authority and may delay release while contacting me or the emergency contact. A late-pickup fee may apply after 15 minutes, as communicated by F.I. For Kids. If Child is not picked up after reasonable efforts to contact me and the emergency contact, F.I. For Kids may contact local law enforcement or another appropriate child-safety authority if reasonably necessary to protect Child.
A parent or guardian who remains at the event location retains parental or guardianship responsibilities and must follow safety instructions without interfering with Program operations.
6. Program Policies and Removal. I will ensure that the Child and any attending parent/guardian follow Program and venue rules and reasonable directions from F.I. For Kids personnel, including applicable health, safety, conduct, and attire requirements. F.I. For Kids may remove the Child from an activity or require prompt pickup if it reasonably determines that the Child’s or a parent/guardian’s conduct presents a safety, health, or material disruption concern. A behavior-related early removal or pickup does not entitle me to a refund, credit, reimbursement, or make-up session, except as required by law or expressly agreed in writing.
7. Class Cancellation and Refund Policy. I understand that F.I. For Kids classes require advance preparation, including purchasing materials and scheduling instructors based on enrollment. Cancellations made at least seven (7) days before the class are eligible for a refund to the original payment method, less a five percent (5%) processing fee. No refunds will be issued for cancellations made fewer than seven (7) days before the start of class.
If Child develops a sudden illness or an unexpected circumstance prevents attendance, I will contact F.I. For Kids before class begins. At its discretion, F.I. For Kids may offer a courtesy accommodation. Courtesy accommodations have no cash value and are not guaranteed.
No refunds, credits, or transfers are available for no-shows or cancellations received after class begins. A registration may be transferred to another age-eligible child if F.I. For Kids is notified in advance and the substitute child’s parent or legal guardian completes all required registration information, consents, and waivers in advance. For safety and legal reasons, children who have not been properly registered will not be permitted to participate.
F.I. For Kids reserves the right to cancel a class for any reason. If F.I. For Kids cancels a class, the parent or legal guardian who completed the registration will receive a full refund to the original payment method.
8. Release and Waiver of Claims. To the fullest extent permitted by law, on behalf of myself, Child, and our respective heirs, personal representatives, and assigns, I release, waive, discharge, and covenant not to sue F.I. For Kids; its owners, officers, directors, employees, instructors, volunteers, agents, contractors, affiliates, and representatives (collectively, the “Released Parties”) from any and all claims, demands, causes of action, damages, losses, liabilities, costs, and expenses, including attorney fees, arising out of or related to mine or the Child’s participation in the Program, Child’s presence at or use of an event location, or any injury, illness, death, or property damage, including claims alleged to arise from the ordinary negligence of a Released Party. This release does not apply to claims that cannot lawfully be waived under applicable law, including claims arising from a Released Party’s gross negligence, reckless conduct, or intentional misconduct to the extent such claims may not be released.
9. Medical Information and Emergency Care. I certify that Child is physically and medically able to participate in the Program, except as disclosed in writing to F.I. For Kids. In an emergency, if I or the emergency contact cannot be reached or if the circumstances require immediate medical or police evaluation, I authorize F.I. For Kids personnel to obtain reasonable emergency medical evaluation or treatment for Child. I understand that I am responsible for all resulting medical, transportation, and related expenses. This authorization does not require F.I. For Kids or any Released Party to provide medical care.
10. Indemnification. To the fullest extent permitted by law, I agree to indemnify, defend, and hold harmless the Released Parties from and against claims, liabilities, damages, costs, and expenses (including reasonable attorney fees) arising out of or relating to (a) Child’s conduct; (b) my breach of this agreement or of Program or venue rules; or (c) claims asserted by or on behalf of a third party arising from mine or Child’s participation in the Program, except to the extent caused by a Released Party’s gross negligence, reckless conduct, or intentional misconduct.
11. Miscellaneous. This agreement is intended to be as broad and inclusive as permitted by the law of the State of Illinois. If any provision is held invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. This agreement is governed by the law of the State of Illinois, without regard to conflict-of-law rules.
The online registration form, including the Program details, parent/guardian and Child information, emergency contact, authorized pickup information, and the parent’s electronic acceptance of this Agreement, and the attached optional photo / video release authorization are incorporated into this Agreement. This Agreement may be accepted electronically, and an electronic signature or other electronic acceptance has the same effect as a handwritten signature.
I have read and understand this Agreement. I voluntarily consent to Child’s participation in the Program and agree to be legally bound by this Agreement.
